County school system settles lawsuit with teacher

One legal matter between a Carter County teacher and the Carter County School Board recently came to a close.
Kevin Kendall, the teacher, filed a lawsuit against the system and Dr. Kevin Ward during the month of July, but since then, the case has been settled, according to information provided to the Elizabethton Star late Monday night.
The Elizabethton Star previously reported the teacher stated in the lawsuit that he was suspended without pay from his employment with the school system for three days, Wednesday, May 25 through Friday, May 27. His pay was reinstated for one day — May 25, because he was at work for most of the day.
In a letter provided from Director of Schools Kevin Ward, Kendall was notified of his suspension because of “neglect of duty and unprofessional conduct.” The letter went on to state that Kendall was allegedly found sleeping on the job, which the teacher refuted by stating he was reading a book.
The system reportedly agreed to pay Kendall his suspended days, all court costs and to remove the incident from his personnel record.
