A Carter County man who was released from jail on Thursday found himself back behind bars later the same day on charges similar to the ones he had just served time on.
Officers of the Carter County Sheriff’s Office arrested Jeremy Chad Cole, 34, 968 Old Railroad Grade Road, Roan Mountain, on Thursday and charged him with aggravated assault and violation of an Order of Protection.
Cole was released from the Carter County Detention Center on Wednesday after serving a 109 day jail sentence. Cole was sentenced to 11 months and 29 days in jail following convictions for multiple convictions of violation of an Order of Protection, simple assault, domestic assault and possession of Schedule VI drugs. The court granted him probation in lieu of jail time, but after violating the terms of his probation, Cole was ordered to flatten out the original jail sentence of 11 months and 29 days. As a standard range offender, Cole was required to serve 30 percent — or 109 days — of his original sentence.
On Wednesday, CCSO Deputy Jonathan Simerly and Lt. Jeff Markland responded to a home on Old Railroad Grade Road after a 911 caller reported a fight was in progress and one subject was armed with a knife.
When the officers arrived on scene, they spoke with a man and woman who said they were at a relative’s house for a cookout when their nephew, later identified as Cole, came outside cursing at the man and acting belligerent.
“After a few minutes Jeremy pulled a knife on (the man), threatening him,” Simerly said, adding the woman said the officers she called 911 and Cole left the home with his father.
Cole was not at the residence when officers arrived.
The woman also told officers she has an active Order of Protection against Cole, which was granted by the court following a previous incident involving Cole. Simerly said he verified the Order of Protection was still active.
Simerly took out warrants charging Cole with aggravated assault and violation of an Order of Protection. Officers later located Cole and took him into custody.
Cole appeared in Carter County General Sessions Court for arraignment on Friday morning. While in the courtroom, Judge Keith Bowers Jr. signed a warrant charging Cole with violation of probation and it was served on him in the courtroom. According to court records, Cole is currently serving an 11 months and 29 days sentence on probation following a conviction for violation of an Order of Protection in April of this year.
Court records show this incident marks the fifth time in a year that Cole has been charged with violation of an Order of Protection. Cole was convicted on the four previous counts of violation of an Order of Protection.
Cole was previously charged with aggravated assault on two occasions — August 27, 2015, and November 9, 2015 — following allegations he threatened individuals with a knife. Those two aggravated assault charges were later downgraded to simple assault charges as part of a plea agreement.
